Terms of Service

Please read these Terms of Service carefully before accessing or using the Recless platform. This legal document establishes the mandatory conditions and limitations of liability governing the contractual relationship between the User and Recless.

1. General Provisions and Acceptance

This document constitutes a binding agreement between the user (hereinafter, the "User") and Recless (hereinafter, the "Company", "We", "Us", or "the Service"). By accessing, registering, browsing, or utilizing any functionality, API, or tool provided by Recless, the User expressly declares to have read, understood, and agreed to be bound by all the terms and conditions stipulated herein.

If the User does not agree with any of the provisions set forth herein, they must immediately cease all access to and use of the platform. Continued use of the Service following the publication of any modifications to these terms constitutes implicit and unconditional acceptance of such changes.

2. Grant of License and Use Restrictions

Subject to strict compliance with these Terms, Recless grants the User a limited, personal, non-exclusive, revocable, non-transferable, and non-sublicensable license to access and operationally use the Service in accordance with its intended purpose.

This license does not convey any intellectual property rights or ownership in the code, architecture, or design of the software. The User is strictly prohibited from engaging in, directly or indirectly through third parties, any of the following:

  • Copying, duplicating, decompiling, reverse engineering, disassembling, or attempting to extract the source code, underlying ideas, or algorithms of the platform.
  • Modifying, translating, adapting, or creating derivative works based on the Service.
  • Reselling, renting, leasing, redistributing, assigning, or commercially exploiting the Service or any of its components without explicit prior written authorization from Recless.
  • Bypassing, disabling, or interfering with security measures, authentication mechanisms, rate limiting controls, or access restrictions implemented on the platform.

3. Acceptable Use, Conduct, and Content Responsibility

The User is solely and exclusively responsible for all activity conducted through their account and for any content, data, inputs, or assets processed using the tool. The User warrants that their use of the Service will at all times comply with all applicable local and international laws and regulations.

It is strictly prohibited to use Recless to:

  • Generate, process, host, transmit, or distribute unlawful, defamatory, libelous, harassing, hateful, pornographic, deceptive content, or materials that promote criminal or fraudulent activities.
  • Infringe upon or violate patents, copyrights, trademarks, trade secrets, or any other intellectual property rights of third parties.
  • Introduce viruses, worms, Trojans, malicious code, or any files designed to interrupt, destroy, or limit the functionality of computer software or hardware infrastructure.
  • Execute automated scraping, crawling, or Distributed Denial of Service (DDoS) attacks that overload or impair the platform's infrastructure.

Recless reserves the absolute right, though not the obligation, to monitor, block, suspend, or terminate without prior notice any User engaging in conduct that jeopardizes the security, stability, or reputation of the platform.

4. Intellectual Property and Asset Ownership

All industrial and intellectual property rights in and to the Service-including without limitation source code, object code, databases, user interfaces, graphic designs, logos, the "Recless" brand, text, documentation, and underlying methodologies-are the sole and exclusive property of Recless or its respective licensors.

Nothing in this Agreement shall be construed as a transfer or assignment of any intellectual property rights to the User. All rights not expressly granted under this license are reserved by Recless. Any feedback, comments, bug reports, or feature suggestions submitted by the User may be utilized by Recless without any obligation of compensation, royalties, or attribution.

5. Disclaimer of Warranties and Absolute Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. RECLESS EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, UNINTERRUPTED AVAILABILITY, OR ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RECLESS, ITS DIRECTORS, EMPLOYMENT, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE, DATA, BUSINESS INTERRUPTION, THIRD-PARTY INFRASTRUCTURE FAILURES, REPUTATIONAL DAMAGE, OR THE COST OF PROCURING SUBSTITUTE SERVICES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE.

The User assumes all risk and responsibility associated with the use and performance of the software, holding Recless harmless from any third-party claims or legal actions resulting from the User's actions on the platform.

6. Third-Party Services and Dependencies

The operation of Recless relies upon, integrates with, or depends on infrastructure, APIs, databases, and hosting services operated by third parties (such as cloud providers, payment gateways, or authentication services).

Recless exercises no direct control over such third-party providers and therefore assumes no liability for network outages, latency, server errors, service interruptions, or security vulnerabilities originating within third-party systems.

7. Modifications, Suspension, and Account Termination

Recless reserves the unilateral right to modify, update, refactor, suspend, or discontinue temporarily or permanently the Service (or any functionality or pricing tier thereof) at any time without prior notice, without creating any right to compensation or liability toward the User.

Furthermore, Recless may immediately suspend or terminate a User's access to the platform in the event of a breach of any provision of these Terms, upon request by law enforcement or regulatory agencies, or for system maintenance and security reasons. Users may discontinue their use of the platform at any time.

8. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which the founders and operators of Recless reside, without giving effect to any conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be submitted to the exclusive jurisdiction of the competent courts of that region, with the User expressly waiving any other jurisdiction or venue to which they might otherwise be entitled.
